§ 15-32. Illustrative enumeration.

  • Without limiting the power of the city council to declare as public nuisances any other act, condition or thing, the following specific acts, conditions and things are, each and all of them, hereby declared to be and constitute public nuisances:

    (1)

    The maintenance of any but sanitary toilets, and these only in compliance with the public health laws, ordinances and regulations of the state, county and city;

    (2)

    The disposal or accumulation of any vile, decaying or putrescent substance or other offensive material dangerous to public health, in or upon any lot, street or highway, or the escape of any gases or odors to such an extent that the same or any of them shall by reason of such offensive odors become a source of discomfort to persons living or passing in the vicinity;

    (3)

    The deposit or accumulation of manure or other noxious fertilizer, unless it be in fly-proof receptacles;

    (4)

    The presence of polluted water in a well, cistern, spring or other source of water supply, when the water there from is used for human consumption;

    (5)

    Growth of weeds or grass at a height of twelve (12) inches or more;

    (6)

    The presence of rubbish, brush, and any other objectionable, unsightly, or unsanitary matter of whatever nature;

    (7)

    The outdoor storage of any goods, wares, merchandise, commodities, junk, debris, or any other item outside of a completely enclosed building for a continuous period longer than twenty-four (24) hours, unless such items are:

    a.

    Out of public view, behind a solid fence or wall of at least six (6) feet in height.

    b.

    Behind the main structure; or

    c.

    Not visible from a public thoroughfare and/or right-of-way.

    Exemptions: This section shall not apply to construction material and/or equipment which is intended for use within thirty (30) days in construction or renovation on the premises or when there exists an active building permit on the premises. Additionally this does apply to furniture made for outdoor use or landscape containers and objects, or children's play equipment.

    (8)

    The use or storage of any upholstered furniture manufactured primarily for indoor use, including mattresses, may not be used or stored on open porches, in open carports and cannot be visible from a public right-of-way.

    (9)

    The presence of polluted, stagnant, and/or mosquito larvae infested water located in an above or in-ground pool or any other receptacle.
