§ 15-42. Same—Charges for cutting and removing by city.

  • The City of Waxahachie may perform said cutting, mowing, raking and removal of weeds, grass and other materials with its own personnel and equipment, and charge the reasonable expense thereof, or may contract said work to independent contractors to be awarded to the lowest satisfactory bidder. In the event that there are unusual obstructions that must be removed or worked around, such as trees, shrubs, bushes, trash, excavations, foundations, or demolished structures or any other similar impediment, an additional charge can be levied, assessed and collected against such premises for the actual additional cost resulting from said obstructions. The billing will also include an administrative fee. This administrative fee will be the amount of the bill up to a maximum fee of one hundred dollars ($100.00) per premises action. The expenses provided for herein shall be levied, assessed and collected by the environmental health department. If any person shall fail to pay such expenses so assessed thirty (30) days after proper notice, the environmental health department shall thereby perfect a privileged lien on the property involved, to secure the expense to the city, together with ten (10) percent interest from the date such payment is due with the County Clerk of Ellis County, Texas.
