§ 1-15. Extraterritorial jurisdiction.

  • (a)

    The City of Waxahachie hereby declares that the number of persons residing within its corporate boundaries now exceeds twenty-five thousand (25,000).

    (b)

    The City of Waxahachie hereby declares its extraterritorial jurisdiction to extend for a distance of two (2) miles from its corporate boundaries existing on January 3, 2005, except for areas within such distance that lie within the corporate limits or extraterritorial jurisdiction of another municipality on such date, as may be determined by law or intergovernmental agreement then in effect.

    (c)

    The City of Waxahachie hereby directs that its subdivision regulations and other ordinances which have been applied to and enforced within the current extraterritorial jurisdiction of the city by prior act of the city council or by operation of state law shall by applied to and enforced within such extended extraterritorial jurisdiction consistent with the city's corporate charter and state law on January 3, 2005.

    (d)

    This section shall be cumulative of all provisions of ordinances and of the Code of Ordinances for the City of Waxahachie, Texas, as amended, except where the provisions of this section are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and Code hereby are superseded.
