§ 2.06. Vacancies, forfeiture of office, filling of vacancies.

  • (a)

    Vacancies. The office of a councilman shall become vacant upon his death, resignation, removal from office in any manner authorized by law, or forfeiture of his office.

    (b)

    Forfeiture of office. A councilman shall forfeit his office if he:

    (1)

    Lacks at any time during his term of office any qualification for the office prescribed by this charter or by law;

    (2)

    Violates any expressed prohibition of this charter;

    (3)

    Is convicted of a crime involving moral turpitude; or

    (4)

    Fails to attend three consecutive regular meetings of the council without being excused by the council.

    (c)

    Filling of vacancies. Vacancies in the council arising from any cause shall be filled by majority vote of the remaining members of the council. Such appointee shall hold office until a successor is qualified at next regular election for the remaining unexpired term, if any. Notwithstanding the requirements of this section and of section 2.11c. [2.12(c)], if at any time the membership of the council is reduced to less than three for any reason, the remaining members or member of the council may by unanimous vote appoint an additional member or members to raise the membership to three, such appointed member or members to hold office only until successors are qualified by election.
