§ 15-40. Removal of grass and weeds—Notice to owner.

  • It shall be the duty of the Director of Environmental Health of the City of Waxahachie to notify the owner and/or agent of any premises within the city which are grown up in weeds or grass to a greater height than twelve (12) inches, to remove such weeds and grass within ten (10) days. This notice shall be in writing and served personally on the owner/agent to whom it is directed or shall be given by certified mail, return receipt requested, addressed to such owner/agent at their last known post office address on record with the tax office. If the notice is returned undelivered/unclaimed by the United States Post Office, official action to correct the violation shall be continued to a date not less than ten (10) days from the date of the letter. The owner/agent will be notified once per premises violation during the calendar year (January 1st through December 31st). Subsequent violations of the same kind or nature given the same calendar year shall then require a ten-day waiting period from the environmental health department inspection prior to the start of appropriate corrective action as required in section 15-41.
