§ 18-2. Use of property generally.

  • Certain areas adjacent to Lake Waxahachie shall be set aside and regarded by the city as recreation areas and picnic areas for the general use of the public. Other areas adjacent to Lake Waxahachie may be leased, consigned or licensed to lessees, consignees or licensees, for commercial purposes; for the construction of buildings, docks, and other improvements; and for the purpose of making available to the general public commercial recreation. Other areas adjacent to Lake Waxahachie may be reserved for general park purposes, as from time to time the city council may designate. Other areas, adjacent to Lake Waxahachie, may be restricted to the general public, dependent upon the existence or lack of access roads, as well as the existence or lack of desirable safety features. Certain other areas adjacent to Lake Waxahachie, although open to the general public, are subject to the right of certain adjacent landowners for the agricultural use of such lands, consistent with the obligations of the district, and as limited by the general public purpose of the reservoir, as heretofore established by contractual agreement between the district and the adjacent landowners, or as hereafter provided.
