§ 28-26. "C" street paving.

  • (a)

    "C" Street specifications. A type of paving to be known as "C" street paving shall be built to the following specifications:

    Existing roadway shall be scarified, bladed or otherwise manipulated to establish a good cross-section and a smooth profile, after lime stabilization. Lime will be applied to existing base material at a rate to generally achieve optimum unconfined shear strength. Lime treatment will be in general conformance with Item No. 260 "Lime Treatment for Materials in Place" of the latest "Texas Highway Department Standard Specifications for Construction of Highways, Streets and Bridges", hereinafter referred to as "Highway Department Specifications". After proper compaction and shaping, two (2) courses of asphaltic surface treatment will be applied in general conformance with Item No. 322 "Two Course Surface Treatment" of "Highway Department Specifications". Asphaltic material, either AC-5 or AC-10, will be applied in the following method and rates. The first course will be applied at a rate of between 0.2 of a gallon per square yard to 0.3 of a gallon per square yard and fully covered with aggregate. A second course will be applied at a rate of between 0.25 of a gallon per square yard to 0.35 of a gallon per square yard and fully covered with Type A Grade 4 or 5 aggregate as set out in Item No. 302 "Aggregate for Surface Treatments" of "Highway Department Specifications".

    Whenever possible, said paving is to be done with city equipment and personnel, rather than contracted out.

    (b)

    Paving policy and procedure. It is policy of this city council to pave streets that have not been paved at all, or on which existing paving is seriously deteriorated, with "C" type street paving when funds are available to do said paving. The decision of when paving shall be done, and of which streets shall be paved, shall be the decision of the city council, which can be made by motion entered into the minutes of any city council meeting. Property owners or residents of homes abutting on a street needing paving may petition the city council to pave a designated street or portion of a street, and the city council will give due consideration to such requests, but reserves the right to designate such streets for paving as it believes to be in the public interest, including streets on which no petition is received.

    (c)

    Payment for paving. Property owners of property abutting on a section of street shall be assessed a portion of the paving cost as follows:

    (1)

    On streets on which the paved width is twenty-two (22) feet or less, two dollars ($2.00) per front foot shall be assessed to the owners of both sides of the street;

    (2)

    On streets on which the paved width is over twenty-two (22) feet, but not more than twenty-six (26) feet, two dollars and twenty-five cents ($2.25) per front foot;

    (3)

    On streets on which the paved width is over twenty-six (26) feet, two dollars and fifty cents ($2.50) per front foot.

    Streets shall be paved only when the owners of seventy-five (75) percent of the frontage to be paved have each paid at least fifty (50) percent of their assessment in cash, and signed proper, instruments to evidence the remaining part of their debt unless the city council makes a special exception by motion entered into the minutes of any council meeting.
