 Chapter 9. CEMETERIES
 Article I. IN GENERAL

  § 9-2. Same—Certificate of deposit.

  • The following shall be the form of the certificate of deposit issued upon the deposit of funds in the perpetual care fund:

    CERTIFICATE OF DEPOSIT
    IN
    "WAXAHACHIE CITY CEMETERY
    PERPETUAL CARE FUND"

    RECEIVED OF _______ the sum of _____ Dollars ($_____) for deposit in the "Waxahachie Cemetery Perpetual Care Fund" to the account of _______. This amount of money deposited is not less than 63 cents per square foot of lot space. Said fund is deposited for the purpose of providing for the care and maintenance of Cemetery Lot No. _____, Block No. _____, in _______ Addition in the Waxahachie City Cemetery.

    Such fund, it is understood, shall be invested only in United States Government interest-bearing securities, or securities permitted by law in such cases, with the interest or revenues therefrom, to the extent required, to be used for the upkeep of this particular lot, with any excess of revenues therefrom, above the amount necessary for the upkeep of this lot, to be used in the general improvement of the cemetery as a whole. Investments shall be made by the City Manager after approval by the City Council, and the securities to be deposited with the City Depository.

    The least amount accepted from any one burial plot shall be $75.00.

    Accountants making the annual audit of the books of the City of Waxahachie shall audit and make an annual report of the condition of this fund.

    It is understood that the City may, at its discretion, cease operation of the "Waxahachie City Cemetery Perpetual Care Fund" by calling in all Certificates of Deposit and return of funds to the respective depositors, their heirs or assigns, but same shall be irrevocable by depositors, their heirs or assigns.

    As the City Manager in charge of the City Cemetery, I hereby certify that the number of square feet as shown above for this lot is correct.
