§ 14-26. Restrictions on hauling.

  • No person, other than employees of the department of environmental health or the city's contracted agent, may collect or haul garbage, refuse, recycling, or other waste materials within the city, with the following exceptions:

    (a)

    A person may haul garbage, refuse, or recyclables, originating within his personal family dwelling unit to an approved disposal facility, providing his means of conveyance is approved by the department of environmental health as being sanitary and of a type that will prevent the spilling or leakage of its contents, littering and the emanation of disagreeable odors.

    (b)

    The collection, removal, and disposal of all garbage and waste material (other than hauling as permitted in section 14-27) shall be performed by the city under the supervision of the director of environmental health, and for such purpose the city may use city personnel or enter into contracts therefore with any person with or without advertising for bids or both; provided, however, that the director of environmental health may authorize any person to collect, remove, and dispose of waste matter under such terms, conditions, and limitations deemed necessary in the interest of public health, safety, and welfare.

    (c)

    Any person or persons operating a business, commercial or industrial, establishment or institution, is responsible for coordinating an acceptable collection and disposal operation and/or a recycled material recovery operation with the city. No person or business shall be allowed to haul garbage, refuse, recyclables, or other waste materials from businesses or institutions inside the corporate limits of the city without an approved plan or contract from the city under the supervision of the director of environmental health.

    (d)

    Violations. Any person violating the provisions of this article, or collecting or disposing of waste matter inside the city limits without authority from the director of environmental health will be in violation and subject to a fine.
